DESCRIPTION OF PROPERTY:
Everything will be
sold "AS IS – WHERE
IS".
2. HIGHEST
BIDDER ACKNOWLEDGED:
The auctioneer will
acknowledge the
highest bidder.
3.
BID NOT COMMENSURATE:
Auctioneer has the
right to accept or
refuse any
bid.
4.
ABSENTEE BIDS:
The auctioneer will
decide whether
absentee bids
will be allowed.
5.
SALES TAX:
5.5 % Maine Sales Tax
required if you do not have a resale certificate.
6.
RESERVES:
On occasion, one or
more items in our
auction carries
a reserve, it is somewhere below our sales estimate. Reserves
will
be executed by our floor manager who will compete against the audience
until the reserve is exceeded, just the same as an absentee bid.
If you are interested in an item and wish to know if it carries a
reserve,
you may ask the auctioneer prior to the auction.
7.
UNIFORM COMMERCIAL CODE:
The uniform commercial
code, Title 11,
§2-328
applies to this auction sale.
8.
STATEMENT OF BUYER'S PREMIUM:
10% Buyer's Premium is in
effect.
9.
CONDITION OF ITEMS SOLD:
The auctioneer shall
not be responsible
for the
correct description, authenticity, genuineness of, or defect in any
lot,and
make no warranty in connection therewith. No allowance will be
made
or sale set aside on account of any incorrectness, error in
cataloguing,
or any imperfection not noted. No deduction will be allowed on
damaged
articles as all goods being exposed for public exhibition are sold "as
is" and without recourse.
10.
MANNER OF PAYMENT:
Cash or good in-state check;
unless prior
arrangements
are made.
11.
REMOVAL:
All items are to be
paid for before
leaving.
12.
RECORDS:
The record of sale
kept by the auctioneer
and bookkeeper
will be taken as final in the event of any dispute.
13.
ADDITIONAL TERMS & CONDITIONS:
Any additional terms
or conditions of the
sale,
added by the auctioneer, shall be announced prior to the auction.
14.
DISPUTED BID:
In case of a disputed
bid the auctioneer
will
sell only to the two (2) people who have disputed the bid.
